BANKRUPTCY CREDIT COUNSELING IS MANDATORY BEFORE FILING ! Yes. The current bankruptcy law requires that a debtor wanting to file for bankruptcy protection must obtain credit counseling prior to filing a case. The credit counseling must be completed within six months prior to the date the case is filed. After filing, debtors are required to complete a debtor education course before receiving a discharge of debts. This course is in addition to the pre-filing credit counseling. In addition to the credit counseling certificate, the debtor must also provide a copy of most current tax return. In a Chapter 13 case debtor must have filed all four years.
Debtor must all provide the last seven months of paystubs. If married we would need the most current stub from the non- filing spouse.
